AMENDMENT TO HOUSE BILL 1465 




2 AMENDMENT NO. ______. Amend House Bill 1465 on page 8, 
3immediately below line 4, by inserting the following:


4 "(d-5) It is affirmative defense under subsection (c) of 
5this Section if:
6  (1) the person owned or possessed the assault weapon, 
7 assault weapon attachment, .50 caliber rifle, or .50 
8 caliber cartridge prior to the effective date of this 
9 amendatory Act of this 100th General Assembly; 
10  (2) the person possessed the assault weapon, assault 
11 weapon attachment, .50 caliber rifle, or .50 caliber 
12 cartridge while in the presence of a person who holds a 
13 valid Firearm Owner's Identification Card who is above the 
14 age of 21; 
15  (3) the assault weapon, assault weapon attachment, .50 
16 caliber rifle, or .50 caliber cartridge was located in a 
17 vehicle and the registered owner of the vehicle is a person

1 who holds a valid Firearm Owner's Identification Card who 
2 is above the age of 21; or 
3  (4) the assault weapon, assault weapon attachment, .50 
4 caliber rifle, or .50 caliber cartridge was located in a 
5 residence and the owner of the residence is a person who 
6 holds a valid Firearm Owner's Identification Card who is 
7 above the age of 21.".
