AMENDMENT TO HOUSE BILL 2769 




2 AMENDMENT NO. ______. Amend House Bill 2769 by replacing 
3everything after the enacting clause with the following:


4 "Section 1. Legislative findings. 
5 Whereas,
Law enforcement makes an arrest in only 35% of 
6firearm homicides and 21% of firearm
assaults when the victim 
7was Black or Hispanic.
Microstamping is a powerful 
8crime-solving tool that can help law enforcement quickly
solve 
9gun crimes.
Microstamping is a reliable ballistics 
10identification tool, and can greatly enhance
traditional 
11ballistics analysis and the current National Integrated 
12Ballistics Information
Network (NIBIN) system by providing a 
13direct link between a spent cartridge case and a
firearm.
14 The leads generated from a microstamped shell have the 
15potential to help law
enforcement solve gun-related crimes 
16while limiting negative interactions with law
enforcement, 
17especially in minority communities.
While this crime-solving

1technology exists, manufacturers have not yet produced

2microstamp-ready firearms.

3 It behooves the State to install a program in partnership 
4with law enforcement to bring
microstamp-ready firearms into 
5use in Illinois.

6 Section 5. Short title. This Act may be cited as the 
7Microstamping Funding Program Act.

8 Section 10. Definitions. 
9 "Microstamp-ready" means that the firearm is manufactured 
10to produce a unique
alphanumeric or geometric code on at least 
11one location on each expended cartridge
case that identifies 
12the make, model, and serial number of the firearm.
13 "Microstamping mechanism" means a mechanism of the firearm 
14designed and intended
to produce a unique alphanumeric or 
15geometric code on an expended cartridge that
identifies the 
16make, model, and serial number of the firearm.

17 Section 15. Grants for microstamp-ready firearms.  Subject 
18to appropriation, the State shall set aside $500,000 to 
19establish a grant program for microstamp-ready firearms in 
20Illinois. The program will award:
21 (A) Replenishment grants: Grants between $35,000 and 
22$50,000, for the
replenishment of new firearms for their 
23officers. One of these grants shall be for
the Illinois State

1Police, and the other three shall be for three municipal law

2enforcement agencies of towns or cities with a population 
3between 50,000 and
200,000 who purchase firearms for their 
4officers through a Quartermaster
system, in which the 
5Quartermaster is responsible for the purchase, inventory,
and 
6dissemination of uniforms and equipment to officers.
7 (B) New officer grants : Grants between $5,000 to $20,000 
8to law enforcement
agencies of towns or cities with a 
9population between 30,000 and 200,000 to
assist with the 
10purchase of firearms by new officers.

11 Section 20. Administration and restrictions. The grant 
12program shall be administered by the Illinois State Police and 
13the grant funds shall only be used for the purchase of 
14microstamp-ready firearms by law enforcement agencies that are 
15grant recipients.

16 Section 25. Education and training. Education and training 
17associated with microstamp-ready firearms, and integration 
18with
the NIBIN and CGIC centers in Illinois shall be included 
19in the program.


20 Section 30. Grant application and participation. The State 
21shall establish the objectives and provide direction for the 
22program's grant application process, by which qualified law 
23enforcement agencies can apply to receive funds for

1microstamp-ready firearms for use by their officers. Law 
2enforcement agencies participating in the grant program must 
3have their officers using the microstamp-ready firearms as 
4soon as they are delivered.
5 All grants this program must be awarded by June 30, 2022.
6 Law enforcement agencies that have been awarded funds must 
7use funds within one year of receipt or funds will be returned 
8to the State of Illinois.


9 Section 35. Data collection. The Illinois State Police 
10shall collect data from each grant recipient, including but 
11not
limited to:
the number of microstamp-ready firearms 
12purchased,
manufacturer,
number of officers using the 
13microstamp-ready firearms, and
the number of microstamp-ready 
14firearms that are discharged in the first of year of use.


15 Section 40. Penalty.  Any person who knowingly or 
16intentionally changes, alters, removes or obliterates the
name 
17of the importer's or manufacturer's serial number or the 
18microstamping mechanism
of any firearm commits a Class 2 
19felony.".
